Traffic Stops

There are several reasons that you could be stopped while driving a vehicle. Law enforcement only needs reasonable suspicion to make a stop. Reasonable suspicion means they need something more than a hunch but less than real evidence that a crime has or is being committed.

If an officer stops you, it is important to understand appropriate behavior when dealing or communicating with law enforcement. While police misconduct may occur, law enforcement aims to protect the general welfare of society. Therefore, when interacting with a police officer, your respectful behavior and compliance are essential. The following tips may be helpful when and if your vehicle is stopped.

Appropriate Methods Of Conduct In Cincinnati Traffic Stops

  • When the police first approach your vehicle, remember to keep your hands where the police can see them, on the steering wheel.
  • NEVER run or resist, and never touch a police officer, their dog, or their horse, even if you firmly believe in your innocence.
  • At the police officer’s request, you must provide your driver’s license, registration, and proof of insurance.
  • At the police officer’s request, you must provide your name, address, and date of birth. However, you may refuse to answer any other questions without first consulting an attorney.
  • If the police request to search your vehicle, never consent.
  • If the police believe that criminal activity is taking place or that there is evidence of a crime in the vehicle, your car can be searched without a warrant.
  • If the police believe that anyone in the car is armed and dangerous, they can frisk anyone in the vehicle.
  • If the police issue you a ticket, you must sign it, even if you believe you are innocent. Otherwise, you may be arrested.
  • In the unfortunate event that the vehicle stop results in your arrest, the police may search any areas of your vehicle that they believe may contain evidence relevant to your arrest.
  • Never tell the police that they are wrong or that you plan to file a complaint against them. Simply remember the officer’s name and badge number. As soon as possible, write down everything you remember from your arrest.
  • Understand your Miranda Rights –
    • Never make any statement regarding the incident in which you may be involved. Anything you say can and will be used against you in court.
    • You have the right to remain silent. To assert the right, you must clearly inform the police that you would like to exercise it.
    • You also have a right to an attorney. To assert the right, you must also clearly inform the police that you would like to exercise your right to speak with an attorney before and during questioning.
