Advantages and Disadvantages of Mayor’s Court
Unlike many upper-level courts, mayor’s court is relatively informal and it takes place in the evening so many defendants do not have to miss work to attend their hearings. Mayor courts have many of the structural advantages of county courts without the formalities.
A disadvantage of mayor courts is that many believe that they are subject to corruption and individual defendants run the risk of being taken advantage of. The opportunity to be taken advantage of is the reason why having an experienced criminal defense attorney at mayor’s court is so imperative.
Types of Cases in Amberley Village Mayor’s Court
The kinds of cases that are normally charged in an Amberley Mayor’s Court include the following:
- Traffic Violations – typically moving violations such as speeding, failure to stop at a red light, or right-of-way violations under Amberley Village, OH Code of Ordinances Chapter 72.
- Misdemeanors — a Mayor’s court may hear certain misdemeanors such as curfew violations, public indecency, all the way up to first-degree misdemeanors such as carrying concealed weapons, or negligent homicide.
- Operating a Vehicle Under the Influence (OVI) — OVI charges include both alcohol and drugs. OVI cases include minors charged with operating a vehicle under the influence but may also include violations under ORC § 4511.19 or Amberley Village Code § 73.01.
Cases That Are Not Heard in Mayor Court
Mayor’s courts cannot hear cases involving domestic violence, kidnapping, assault, aggravated trespass, violation of protective orders, or stalking charges, even when those charges are misdemeanors. Since mayor courts cannot hold jury trials, if ever a defendant requested a jury trial, then the case would have to be transferred.
Additionally, if an individual is not happy with the outcome of a case decided in mayor’s court, then he or she may appeal the decision, within ten days of the judgment, to municipal or county court.
